The Customer acknowledges to have read all the following information on the General Conditions of sale before completing an order on "PUTIA".

1. Conditions of use
These General Conditions of sale govern the sale of Products (“Product or Products”) by "PUTIA". All contracts for the sale of goods from "PUTIA" to the Customer are disciplined by the present General Conditions, which are effectively part of each proposal, offer and order confirmation in the purchase of the Products. The conditions of sale applied to the order are the ones in effect at the time of the order itself.
By confirming the order on "PUTIA", the Customer acknowledges to have read and accepted the present General Conditions of sale, authorising Michele Spallino to charge the indicated amount of money, comprehensive of the shipping costs and any other additional costs indicated at the moment of the purchase.

2. Purchase
When confirming the order, the Customer purchases the products as they are described in their own "product page", at the indicated price in addition to the shipping costs as shown at the time of purchase. The Customer will be shown a recap of the single costs of the items selected and then the total in case more than one products is purchased, including the corresponding shipping costs. After completing the purchase, the Customer will receive an email with all the order information: date of the order, description of the item purchased, price, selected method of payment and shipping costs.
Michele Spallino accepts orders according to the limits and the amount of products in stock. The order's confirmation on is part is therefore subordinated to the effective availability of the products themselves.

3.Orders - invoice
Each order of Products sent to "PUTIA" is equal to a contract proposal on the Customer's part. When "PUTIA" fulfils an order, it equals a confirmation and acceptance of the same. Tax records of the ordered Products will be issued by Michele Spallino when shipping the products themselves to the Customer. The Customer will have to indicate the exact contact information necessary for product and invoice delivery.

4. Order execution
The order will be carried out as specified on the website (putia.eu). Once the order is confirmed, the customer has payment obligation. As described by the laws regulating the online sale, the Customer has the right to return the purchased item within 14 days, according to our Return policy. In case the order is not fulfilled by "PUTIA" for reasons connected to the non-availability of the product purchased, "PUTIA" will inform the Customer as soon as possible concerning the delivery time of the missing product. If the Customer has no intention of waiting the additional time, "PUTIA" will refund the costs of the purchase.
In case the Product is broken, out of stock or in general unavailable, "PUTIA" will notify the Customer and provide a time limit for its availability.
The Customer will confirm via email whether he wants to wait for the product to be available or prefers to ask for a refund.

5. Acceptance of the order
The conclusion of the contract will take place only when "PUTIA" confirms the order.
The Customer will receive via email a confirmation of the order plus all the information of the order itself (items purchased, prices, shipping costs ...).
"PUTIA" reserves the possibility to not confirm the order for any reason, specifically those related to issues concerning the order itself or the product's availability.

Payment of the items purchased and consequent shipping costs are fulfilled by the Customer when confirming the order. The methods of payment accepted on "PUTIA" are:

7. Shipping and deliveries

"PUTIA" delivers the products with modalities and time indicated in the shipping option selected by the Customer at the time of the purchase. The delivery time is approximate and is not in any way binding for "PUTIA": it can vary based on the order itself (for example, if the product is not immediately available) or for other reasons which depend on the couriers tasked with the shipping.
It's important to know that:
When receiving the package, the Customer will have to verify its content and the state of the products. "PUTIA" recommends to do so before signing the acknowledgement of receipt and specifically to check the following:
  • that the number of packages correspond to what is indicated in the delivery note.
  • that the packaging is intact, that there’s in no sign of breaking, that the package does not appear squashed, wet or any other alteration that might have compromised its content.

In case the Customer notices any anomaly, the Customer has to refuse the delivery or complain with the courier, by writing a detailed document of “acceptance with reservation”, with date and package information. If the delivery note is signed without reserve, the Customer will not be able to contest the state of the package later. Potential issues concerning the physical integrity of the package, its correspondence to the products ordered by the Customer and the state of what the Customer received will have to be notified within 3 (three) days after the delivery by sending us an email at ordini@putia.eu.

"PUTIA" has the right to make shippings and deliveries with a courier of its own choice.

8.Right to withdraw

Pursuant to art. 5 of DLGS May 22nd 1999 n. 185, the Customer (if qualified as "Consumer" according to art.1 lett b) of DLGS May 22nd 1999 n. 185) has the right to withdraw from the contract and to return the purchased Products, without any penalty or need to state the reason for doing so, within a 14 (fourteen) days period after receiving the Products.
The period of withdraw expires after 14 days from the day the Customer (or a third party different than the courier and designated by the Customer) acquires physical possession of the goods.
To exercise the right to withdraw, the Customer will have to write us at the following address:

informing us of the decision to withdraw from the present contract through an explicit declaration (for example, a letter sent through mailing post, fax or email). In order to fulfil the terms of withdraw, the Customer needs to send the request before the end of the 14 days period.

9. Effects of withdraw
By withdrawing from the contract, the Customer will be refunded of all the payments made to "PUTIA", including shipping costs, without delay and in any case within 14 days after we have been inform of the Customer's will to withdraw from the present contract.
The refund will be carried out through the same payment method used in the initial transaction, unless the Customer specifically indicates otherwise. In any case, the Customer will sustain no costs as a consequence of the refund.
The refund can be suspended until the goods are received by "PUTIA" or until the Customer can prove they were shipped. The goods to be returned have to shipped at the following address:

without delay and in any case within 14 days after the Customer notified us of the intention to exercise the right to withdraw from the present contract. The terms are respected if the goods are shipped before this deadline. The costs of the return of the goods will be charged on the Customer.

The returned goods must be re-saleable.

10. Customer's data
The processing of the information provided by the Customer, including the management of the users' email address, is carried out according to the legal provisions. Names and other information are essential to process and forward the orders, to create the invoice and potential guarantee agreements.
For this purpose, such information can be provided to "PUTIA"'s contract partners.
The Customer can oppose to such communication and as described by the law, can access, modify, rectify and delete his/her personal data and information by addressing:

In order to avoid any kind of scam, "PUTIA" has the right to ask the Customer to verify his/her identity and address.

11. Electronic signature
The "click of confirmation" is equal to an electronic signature. This signature has - between the parts involved - the same value as a handwritten signature.

13. Disputes
The present contract is regulated by the Italian laws.
In case any controversy or dispute arises deriving from a purchase on "PUTIA" or from the present General Conditions of sale and in order to resolve the conflict, the parts are subjected to the competence of the city court where the Customer is resident.

In case of an ongoing controversy and an impossibility to find an agreement between the parts, notwithstanding the possible applicability of binding dispositions of laws designed to protect consumers (as defined by art.1 lett b0 of DLGS May 22nd 1999 n.185), any controversy connected to the present general Conditions of sale will be assigned to the exclusive competence of the Court of Termini Imerese (PA). As described and as a consequence of art. 1341 and 1342 of the civil code, the Customer declares to have carefully read, understood and accepted specifically all the clauses present on "PUTIA"'s General Conditions of sale.

The Customer can furthermore access the European online platform ODR (Online Dispute Resolution) in order to resolve any dispute between Seller and Consumer. The ODR Platform is developed and managed by the European Commission, according to the 2013/11/EU Guideline and to the EU Regulation n. 524/2013, designed to facilitate the independent, impartial, transparent, efficient, fast and equal resolution of any dispute concerning contract obligations which derive from online sale contract or services between a consumer and a seller.
